Vendor Contract
  • We wish to participate as a vendor at the Loch Norman Highland Games organized by Historic Rural Hill, Inc. (afterwards referred to as HISTORIC RURAL HILL) on April 12th & 13th, 2025 and agree to the following:

    1. Pursuant to the contract between Mecklenburg County Parks and the HISTORIC RURAL HILL for the use of Rural Hill, the vendor agrees to provide certificate of insurance naming Mecklenburg County Parks and Recreation and HISTORIC RURAL HILL as an additional insured with policy limits as follows:

    A. Comprehensive General Liability - $1,000,000. combined single limit. The policy will be endorsed to include product liability when applicable.

    B. Automobile Liability - covering all owned, non-owned, leased, and hired vehicles in the amount of $300,000.00 combined single limit for bodily injury and property damage 10 day notice of cancellation is required. The waiver, release and discharge set forth in the following paragraphs expressly extends to include action or inaction attributable to Mecklenburg County Parks and Recreation and HISTORIC RURAL HILL their heirs, successors, assigns, agents, servants, employees, Board of Directors and Officers’ failure to fulfill in every respect any and all duties or obligations imposed upon it under any provision, term, condition, and/or covenant of this Vendor Agreement.

    2. As an express condition of this agreement, vendor, on behalf of himself, his heirs, successors and assigns voluntarily agrees to waive, release and discharge Mecklenburg County Parks and Recreation and the HISTORIC RURAL HILL, their agents, servants, employees, heirs, successors and assigns of and from any and all claims, demands, damages, actions and causes of action (including attorneys' fees and costs), of any nature whatsoever, due to any and all loss or damage occasioned by Mecklenburg County Parks and Recreation or the HISTORIC RURAL HILL, Inc., (whether direct, indirect, or consequential), regardless of its cause or origin, including but not limited to the negligence of Mecklenburg County Parks and Recreation or the HISTORIC RURAL HILL, its agents, servants, employees, Board of Directors and officers.

    3. Vendor further agrees to indemnify and hold harmless Mecklenburg County Parks and Recreation and the HISTORIC RURAL HILL, their heirs, successors, assigns, agents, servants, employees, Board of Directors and officers, of and from any and all claims, demands, damages, actions, or causes of action (including attorneys' fees and costs), of any nature whatsoever, that arise out of or are in any way related to the Vendors concession, activities, or other operations, including but not limited to, any and all claims, demands, damages, actions or causes of action, (including attorneys' fees and costs), due to or resulting from personal injury or death, or damage to property, which may be incurred or sustained by any member of the public, participant, other vendor, or any other person who is connected with or who is present at the Loch Norman Highland Games. Vendor, Mecklenburg County Parks and Recreation and the HISTORIC RURAL HILL agree that TEN ($10.) DOLLARS of the consideration paid for vending space is expressly designated as consideration for the indemnity & hold harmless provisions contained in this paragraph.

    4. Mecklenburg County vending permits will be the responsibility of the vendor. North Carolina (State) & Mecklenburg County Sales taxes (7.25%) will be the responsibility of the Vendor. Vendors must not represent themselves as sponsored by or affiliated with the HISTORIC RURAL HILL.

    5. Tents are required to be rented from the Historic Rural Hill, Inc.

    6. Sites will be assigned by Historic Rural Hill staff.

    7. Control of trash at the vending site will be the responsibility of the vendor. Receptacles, as well as pick-up and disposal will be provided by HISTORIC RURAL HILL.

    8. Vendor acknowledges that the Vendor Committee will be reviewing its displays, products, goods, and services to ensure compliance with the stated goals of the HISTORIC RURAL HILL of offering the finest collection of products, goods, and services available to those who attend the Loch Norman Highland Games.

    9. All merchandise, displays, boxes, containers, and additional fixtures, are to be kept within the perimeter of the vendor's tent and designated space, preferably tucked under the tables and out of sight. We need to keep the pathways clear for emergency vehicles, as well as pedestrian traffic to avoid trip hazards. Anyone in violation will be issued a warning and will be subject to removal as a vendor if deemed non-compliant to our policies. Historic Rural Hill, Inc. retains the right to enforce these policies.

  • Pursuant to Mecklenburg County Ordinance, Rural Hill is now a tobacco-free zone. This includes both smoking, smokeless tobacco, e-cigarettes, vaporizers and other such devices.
